Purpose of granting civil service status:
Employees in positions of particular responsibility shall be able to implement laws free from any influence and pressure by external parties without having to fear employment-related disadvantages.

Granting civil service status means that the employer waives its right to terminate the employment relationship (dismissals are also possible in the case of public officials). Requirements for granting civil service status:

  • Austrian citizenship (for exceptions, see Sec. 5 (2) of the Oö. LBG);
  • full legal capacity;
  • personal, medical and professional suitability;
  • at least the 24th year of life, but not the 45th year of life has been completed at the time of granting civil service status (the candidate must be 40 years of age at maximum upon entry into state service);
  • at least two years in state service;
  • free civil service post in the course of the post schedule;
  • degree of employment of at least 20 weekly hours in the last two years before obtaining civil service status (the times of maternal or paternal leave as well as of part-time work for childcare, even if less than 20 weekly hours, shall be taken into account in such period to the extent of one year at maximum);
  • above-average work performance;
  • successful service training (Module 2) or equivalent service training in the past;
  • no past employment relationships under public law with the State of Upper Austria;
  • no employment relationship under public law with other regional authorities or comparable institutions;

Areas where civil service status is granted:

  • District Administration Authorities (from administrative clerk level upwards),
  • specialist service,
  • central strategic departments, specialist departments of the authority (from administrative clerk level upwards),
  • cases as provided for by law (e.g. judge at the Upper Austrian State Administrative Court) or also
  • in justified cases in other areas (high degree of responsibility, leading position, particularly conflictual customer interaction).

Civil service status is not granted:

  • in institutions and companies,
  • in schools (teachers and administrative staff in music schools, agricultural and forestry schools, private schools, Anton Bruckner Private University),
  • in cultural institutions or
  • to supporting staff and craftspeople.
